     Public letter to minister of China Railway Ministry,from HAO Jinsong  

 

Nothing stops my yearning for the light . In the deep darkness, we light up a candle to walk on the way to the democracy.

Mr. Hao Jinsong, the founder of the Public Interest Lawyer Center, graduated from the China University of Political Science and Law, advocates for the theory of “duplex litigation”, which means challenging unreasonable and unjust regulations by using intensive legal measures . He had sued the national ministries, commissions and some monopolistic groups nine times for the public welfare, instead of personal interest. He launched litigation to the National Railway Bureau three times for invoiceswere refused to be provided to him after he paid money for food on the train. Finally he won the cases and the National Railway Bureau had issued a notification to all branch bureaus in China that they must provide invoice to customers, which ended the history of “no-invoice” on train. For his outstanding contribution to breaking down the “bully clause” contained in contract, he was ranked the top ten respected persons of establishing harmonious economy by the Sina.com and the Global Finance and Economics in 2005. And he was also nominated as the Legal and Media Figure in 2005 and top ten Legal Figures in 2005. Two cases he represented were written into the ten Famous Cases in 2005 as well as the ten Influential Litigation in China in 2005. He himself was written into the Blue Book of China’s Rule of Law in 2005 named as a fighter for the public welfare.

In April 2006, Mr. Hao Jinsong sued the National Railway Bureau for it did not call a hearing before rising up the ticket price during Spring Festival. On December 1 st , the No. 1 middle court of Beijing declared that Mr. Hao lost the suit. Immediately Mr. Hao appealed to the high court of Beijing . On January 7 th , he published his open letter to Mr. Liu Zhijun, the minister of the National Railway Bureau to protest against the price rising policy in Spring Festival. On January 10 th , three days after his petition, the National Railway Bureau announced that it would not rise up the ticket price in Spring Festival any more. And on January 2007, Mr. Hao was written into the Blue Book of China Rule of Law in 2006.

We are a team constituted by lawyers and legal scholars fighting against the injustice by means of legal approach. We are working like the warriors, fighting in the front line without any fear. We insist that the law is the faith, or it is rendered in vain. We focus on the progress of democracy and rule of law in China ; we concern the underprivileged groups, including those children that are deprived of education right, farmers who lost their land, and those petitioners that calling for justice. We are dedicated to the public welfare by means of holding forums concerning constitutional rights, conducting research on pioneering issues in China and publishing the research reports to put forward our suggestions to solve those problems.

We believe that along with the consciousness of civil rights and rule of law , China will develop into a democratic country under the rule of law in the future. We are trying to explore the possibility for people the general public to join in political decisions by means of promoting the institutional reform. We think that by using legal approach we can urge the government to change the unreasonable and unjust public policies. We aim to help to strengthen the judicial bodies to play an important role in the social transformation, and to urge more people to participate in the decision-making process.

We believe that the Rule of Law is universal. According to China ’s Constitution, no one is at a higher position than the Constitution and the laws, and there is no exception for any party, organization, group, individual, even if the government and troops. We deem that a person can express his disagreements to a certain law or regulation by legal measures instead of violence. If more people can protest against an unjust phenomenon by bringing an action to court, there will be more pressure on the injustice. Therefore, we anticipate the public welfare litigation will play an important role in promoting democracy and rule of law in China .

Looking back into the history, we will find that it is the time for democracy and rule of law in China . Now China is in the transitional stage to the rule of law, and the authority of law is in shape. We hope we can live in a country that provides everyone equal opportunity to live a happy life, no matter what the gender, age, ethnic background, education, family background and degree is. To establish a harmonious society under the rule of law, we need more help from the common people. We are looking forward to your financial support and also welcome you to join in us.

the use of fund:

First, we will continue to launch public interest suit and to promote the hearing system in the whole society, so as to improve the platform for communication between the public and the government.

Second, we will do research on the railway ticket sale process to promote the transparency of ticket sale.

Third, we plan to do research on the election system and practical situation of the National People ’ s Congress deputies to promote people ’ s election rights.

Forth, we will provide legal aid to the typical public interest cases around China to promote its influence.

Fifth, we will award the most outstanding individuals and teams in the field of public interest suit annually.

Sixth, a part of the funds will be used for administrative expense including forums and meetings.
